50-state rundown on gay marriage laws

Six months after gay and lesbian couples began legally marring in Massachusetts, opponents of same-sex marriage swept Election Day, with voters in 11 states approving constitutional amendments codifying marriage as an exclusively heterosexual institution.

The amendments won in Arkansas, Georgia, Kentucky, Michigan, Mississippi, Montana, North Dakota, Oklahoma, Ohio, Utah and even Oregon the one state where gay rights activists had hoped to prevail.

The amendments passed with a 3-to-1 margin in Kentucky, Georgia and Arkansas, 3-to-2 in Ohio and 6-to-1 in Mississippi. Bans passed by narrower margins in Oregon, about 57 percent, and Michigan, about 59 percent.

"Yesterday's vote reveals once again the broad support for protecting marriage among the American people," said Tony Perkins, president of the conservative Family Research Council.

Gay-rights activists have filed challenges to the new amendments in Georgia and Oklahoma.

In Louisiana, a judge recently struck down a constitutional same-sex marriage ban approved in September on grounds that it improperly dealt with more than one issue by banning not only same-sex marriage but also any legal recognition of domestic partnerships or civil unions. Louisiana's constitution requires that amendments be limited to a single-subject.

Three other states that also have single-subject requirements - Georgia, Ohio and Oklahoma may face legal challenges similar to the one in Louisiana, said Kristina Wilfore, executive direct of the Ballot Initiative Strategy Center , a Washington, D.C.-based organization that supports progressive ballot measures.

Since Massachusetts began allowing gay and lesbian couples to wed last May, 13 states have approved constitutional bans on same-sex marriage. This number includes Missouri, which approved such a measure in August.

The amendments in Mississippi, Montana and Oregon refer only to marrriage, specifying that it should be limited to unions of one man and one woman. The measures in Arkansas, Georgia, Kentucky, Michigan, North Dakota, Ohio, Oklahoma and Utah call for a ban on civil unions or other partnership benefits as well.

None of these states allowed gay marriage before, but the stakes were highest in Oregon, where city officials in Portland married nearly 3,000 same-sex couples last spring before a judge halted the practice. The state's highest court will hear arguments Dec. 15 on the validity of those marriages.

National and local gay-rights groups campaigned vigorously in Oregon, raising and spending millions of dollars, but they failed to defeat the amendment, which is expected to lead to the nullification of the 3,000 same-sex marriages.

"It is always wrong to put basic rights up to a popular vote," said Matt Foreman, executive director of the National Gay and Lesbian Task Force. "In the end, the U.S. Supreme Court will decide on marriage equality and it will base its decision on the U.S. Constitution, not anything in any of the state constitutions."

Currently, more than 20 lawsuits seeking same-sex marriage rights are being pursued in 11 states: California, Connecticut, Florida, Indiana, Maryland, Massachusetts, Nebraska, New Jersey, New York, Oregon and Washington. Most of the suits are modeled after a Massachusetts case filed by seven same-sex couples who successfully argued that the Bay State Constitution guarantees them the right to marry.

Washington state's Supreme Court is expected soon to hear appeals of two lower court rulings that struck down the state's six-year-old statute banning same-sex couples from marrying.

Lawsuits pending in California and New Jersey also have been appealed to their state's highest courts and could be decided in the next year.

Courts that already have looked at the issue in Massachusetts, Vermont, Alaska and Hawaii have ruled in favor of gay unions. In both Alaska and Hawaii, however, the court rulings later were overridden by state constitutional amendments banning same-sex marriage.

Vermont's high court allowed the Legislature to ban same-sex marriage as long as it provided an alternative for gays and lesbians called civil unions, while the Massachusetts Supreme Judicial Court ordered its Legislature to provide nothing less than marriage.

Since the Massachusetts ruling, more than 35 states have introduced legislation aimed at preserving the traditional definition of marriage as a union between a man and a woman.

The legislative activity takes three basic forms:
  • State constitutional amendments -- The toughest involves enshrining a ban on marriage of same-sex couples in the state constitution and were adopted by 13 states in 2004. In seven states - Georgia, Kentucky, Louisiana, Mississippi, Missouri, Oklahoma and Utah - Legislators approved putting constitutional amendments on ballots, while in the six other states - Arkansas, Michigan, Montana, North Dakota, Ohio and Oregon the measures were advanced by conservative, church-backed citizens groups that collected signatures on petitions. All required a statewide vote to pass.


  • Missouri voters approved a same-sex marriage-ban amendment August 2. On Oct. 5, a Louisiana judge struck down the constitutional ban on same-sex marriage that voters had overwhelmingly approved Sept. 18. Voters in Arkansas, Georgia, Kentucky, Michigan, Mississippi, Montana, North Dakota, Ohio, Oklahoma, Oregon and Utah approved their amendments on Election Day. Similar measures were approved by legislatures in Massachusetts, Tennessee and Wisconsin, but must be approved again in 2005 before going to a statewide vote that year in Wisconsin and in 2006 in Massachusetts and Tennessee.

    Three states Alaska, Nebraska and Nevada already had bans against same-sex marriage written into their constitutions. A fifth state, Hawaii, passed an amendment reserving the right to define marriage for the state Legislature, which bans gay marriage.

  • Marriage statutes -- Sixteen states debated and five of those adopted -- statutory legislation this year that either prohibit same-sex marriage, strengthen pre-existing gay marriage bans and/or prohibit granting marriage-like benefits to same-sex couples in lieu of marriage such as those provided under Vermont's civil unions law. Those that toughened their marriage laws were New Hampshire, Ohio, Oklahoma, Utah and Virginia.


  • Non-binding resolutions -- At least 20 states considered non-binding resolutions urging Congress to pass a federal constitutional amendment banning same-sex marriage, and two Alabama and Virginia adopted them. A federal constitutional amendment was proposed in Congress but the Senate in July failed to rally enough support to bring it to a vote. Republican leaders vow to bring it up again this fall.


Thirty-nine states already prohibit gay and lesbian couples from marrying with laws modeled after the federal Defense of Marriage Act (DOMA). Passed by Congress in 1996, the federal DOMA bars federal recognition of same-sex marriages and allows states to ignore gay marriages performed elsewhere. Four states (Maryland, New Hampshire, Wisconsin and Wyoming) have laws or court rulings prohibiting same-sex marriage that predate the federal DOMA.

Following is a 50-state roundup of current law and proposals to change state marriage laws.

    ALABAMA
  • Current law: DOMA adopted as state law
  • Legislation:Resolution urging Congress to pass a federal constitutional amendment banning same-sex marriage has been adopted. (HJR 129). State constitutional amendment to ban same-sex marriage introduced but failed.

  • ALASKA
  • Current law: DOMA written into state constitution and state law
  • Legislation: None

  • ARIZONA
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment was introduced but failed (SCR 1015). A resolution urging Congress to pass a federal constitutional amendment banning same-sex marriage passed the state House but failed in the Senate (SCM 1004).

  • ARKANSAS
  • Current law: DOMA written into state constitution and state law
  • Legislation: A state constitutional amendment to ban same-sex marriage placed on the November ballot through the citizen initiative process was approved by voters.

  • CALIFORNIA
  • Current law: State law, passed by public referendum, bans same-sex marriage (In defiance of that law, San Francisco issued more than 3,200 marriage licenses to same-sex couples. The state high court is expected to rule on the validity of those marriages). The state will extend certain state-level marriage benefits to those on a domestic partners' registry starting Jan. 1, 2005.
  • Legislation: Assembly Judiciary committee on April 20 became the first legislative body in America to approve a measure that would allow same-sex couples to wed, but the legislation has not been considered by full Assembly (AB 1967). Resolution introduced urging Congress to pass a federal constitutional amendment banning same-sex marriage (AJR 67).   • Court action:State Supreme Court on August 12 nullified nearly 4,000 marriage licenses issued to same-sex couples in San Francisco in violation of state law. The high court is expected to hear a separate case that will decide on the constitutionality of banning same-sex marriage at a later date.

  • COLORADO
  • Current law: DOMA adopted as state law
  • Legislation: Resolution urging Congress to pass a federal constitutional amendment banning same-sex marriage was introduced, but died (HJR04-1013).

  • CONNECTICUT
  • Current law: State adoption statute refers to marriage as a union between a man and a woman.
  • Legislation: Bill introduced to allow same-sex couples to marry (HBO 3069).
  • Court action:Gay and Lesbian Advocates and Defenders, the legal group that won marriage rights for same-sex couples in Massachusetts, filed a lawsuit in state court Aug. 25 on behalf of seven same-sex couples seeking the right to marry.

  • DELAWARE
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment forbidding same-sex marriages and civil unions introduced March 31, but Senate President Thurman G. Adams (D) has blocked the measure from coming to a vote (SB 246).

  • FLORIDA
  • Current law: DOMA adopted as state law
  • Legislation: None
  • Court action: Miami lawyer Ellis Rubin has filed 8 lawsuits 3 federal cases and 5 state cases in 2004 on behalf of about 40 same-sex couples. Two of the federal cases seek recognition of marriages performed in Canada and Florida and challenge the federal Defense of Marriage Act. The other cases were filed on behalf of unwed same-sex couples seeking the right to marry. None have gone to trial yet. The National Center for Lesbian Rights has filed a lawsuit on behalf of six same-sex couples challenging Florida's same-sex marriage ban.


  • GEORGIA
  • Current law: DOMA written into state constitution and state law
  • Legislation: State constitutional amendment defining marriage as the union between a man and a woman was approved by the Legislature and by 85 percent of voters on Nov. 2.
  • Court action:A trial court judge dismissed a lawsuit Sept. 29 seeking to remove the same-sex marriage ban from the ballot. Gay-rights advocates say they will re-file the lawsuit now that the amendment has been approved by voters.

  • HAWAII
  • Current law: Constitutional amendment giving the legislature the right to reserve marriage to opposite-sex couples. DOMA passed by the legislature and adopted as state law by public referendum. But Hawaii law provides limited state benefits to same-sex partners.
  • Legislation: None.

  • IDAHO
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment banning same-sex marriage passed the state House Feb. 11, but was not voted on in the Senate before the legislature adjourned in March (HJR 009).

  • ILLINOIS
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendments banning same-sex marriage introduced but failed to pass (HJRCA 24, SJRCA 56, HJRCA 25, HJRCA 31). Resolution introduced urging Congress to pass a federal constitutional amendment banning same-sex marriage .

  • INDIANA
  • Current law: DOMA adopted as state law
  • Legislation: The Legislature adjourned March 4, effectively killing a proposed state constitutional amendment banning same-sex marriage. The measure passed the state Senate but stalled in the House when Democrats refused to bring it to a vote. Republicans unsuccessfully attempted to force a vote by stalling all legislative activity for one week by refusing to enter the House chambers. (HJR 3, SJR 7).
  • Court action: The Indiana Civil Liberties Union filed a lawsuit on behalf of three same-sex couples challenging Indiana's same-sex marriage ban. The case was dismissed by a trial court judge in 2003 and is currently pending in the state Court of Appeals.

    IOWA
  • Current law: DOMA adopted as state law
  • Legislation: Senate voted down a state constitutional amendment banning same-sex marriage (SJR 2002). Proposed state law that would prohibit recognition of same-sex marriage or any legal union that provides marriage-like benefits failed (SF 216). Resolutions urging Congress to pass a federal constitutional amendment banning same-sex marriage also have been introduced and approved by committees in both chambers (HJR 2002, SJR 2005).

  • KANSAS
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment banning same-sex marriage and benefits that associate marriage to other relationships was approved by the state Senate May 1 but narrowly defeated in the state House May 4 (HCR 5005). A similar measure had narrowly passed the House in March but was voted down by the Senate.

  • KENTUCKY
  • Current law: DOMA written into state constitution and state law
  • Legislation: State constitutional amendment defining marriage as the union between a man and a woman was approved by the Legislature April 19 and by nearly 75 percent of voters Nov. 2.

  • LOUISIANA
  • Current law: DOMA written into state constitution and state law
  • Legislation: Constitutional amendment restricting marriage to opposite-sex couples and prohibiting state officials and courts from recognizing same-sex marriages or civil unions performed elsewhere was passed by a 4-to-1 margin Sept. 18.
  • Court action: A district judge struck down the constitutional ban on same-sex marriage Oct. 5, ruling that the measure was flawed as drawn up by the Legislature because the provision had more than one purpose banning not only same-sex marriage but also civil unions. Opponents plan to appeal the ruling.

  • MAINE
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment banning same-sex marriage was proposed but failed in both legislative chambers.

  • MARYLAND
  • Current law: The first state law defining marriage as a union between a man and woman was adopted by Maryland in 1973.
  • Legislation: State constitutional amendment and proposed state law banning same-sex marriage were introduced and defeated (HB 16, HB 728, SB 746).
  • Court action: The American Civil Liberties Union filed a lawsuit July 7, 2004 challenging the state's same-sex marriage ban on behalf of nine same-sex couples and a man whose partner recently died.

    MASSACHUSETTS
  • Current law: The Massachusetts Supreme Judicial Court has ordered legislation to allow same-sex couples to marry by May 17, 2004.
  • Legislation: State constitutional amendment banning same-sex marriages but establishing civil unions gained preliminary approval March 29 during the state Constitutional Convention. The measure must be approved in identical form during the next legislative session in 2005 before going to a statewide vote in 2006. Three bills introduced to permit same-sex couples to marry but are not likely to come to a vote (HB 3556, HB 3677, SB 935). A citizen initiated petition drive is under way to amend the constitution to ban same-sex marriage and civil unions, but 2008 is the soonest it could come to a statewide vote.
  • Court action: Gay and Lesbian Advocates and Defenders filed a lawsuit July 2004 challenging a 1913 law that prohibits out-of-state same-sex couples from marrying in Massachusetts. On August 17, a trial court upheld the 1913 law but GLAD said it will appeal the ruling.

    MICHIGAN
  • Current law: DOMA written into state constitution and state law
  • Legislation: State constitutional amendment banning same-sex marriage placed on the Nov. 2 ballot by citizen initiative groups and approved by 59 percent of voters.
  • Court action: The state Court of Appeals ruled Sept. 3 that the proposed constitutional ban on same-sex marriage should appear on the Nov. 2 ballot even though the state canvassing board could not overcome a partisan deadlock to certify the measure.

  • MINNESOTA
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment banning same-sex marriage was introduced but died when the legislature adjourned May 14 without voting on the measure.

  • MISSISSIPPI
  • Current law: DOMA written into state constitution and state law
  • Legislation: State constitutional amendment defining marriage as the union between a man and a woman was approved by the Legislature and passed by voters on Nov. 2.

  • MISSOURI
  • Current law: DOMA adopted as state law and written into constitution Aug. 3
  • Legislation: None

  • MONTANA
  • Current law: DOMA written into state constitution and state law
  • Legislation: State constitutional amendment banning same-sex marriage placed on the Nov. 2 ballot by citizen initiative groups and approved by voters.

  • NEBRASKA
  • Current law: DOMA written into state constitution
  • Legislation: None
  • Court action: The American Civil Liberties Union filed suit in 2003 in federal court in Nebraska challenging the state's constitutional amendment banning same-sex marriage.

    NEVADA
  • Current law: DOMA written into state constitution
  • Legislation: None

  • NEW HAMPSHIRE
  • Current law: State law bans same-sex marriage and pre-dates DOMA laws.
  • Legislation: The state House and Senate have approved a bill that would reinforce a state law banning same-sex marriages and prohibit recognition of gay marriages performed elsewhere (SB 427). Republican Gov. Craig Benson has said he would sign it.

  • NEW JERSEY
  • Current law: State law provides for a domestic partners' registry with marriage-like benefits for same-sex couples.
  • Legislation: Bill introduced proposing adoption of DOMA to prevent gay and lesbian couples from marrying (AB 460). Resolution introduced urging Congress to pass a federal constitutional amendment banning same-sex marriage .
  • Court action: Lambda Legal filed a case on behalf of seven same-sex couples seeking the right to marry. A trial court judge dismissed the case in November 2003. Lambda is seeking an appeal to the state Supreme Court.

    NEW MEXICO
  • Current law: No public policy
  • Legislation: None

  • NEW YORK
  • Current law: No public policy
  • Legislation: State law proposed that would prohibit recognition of same-sex marriages or civil unions performed elsewhere (A 2998). Bill that would recognize same-sex marriage has been proposed in the state Senate (SB 3816) and in the Assembly (AB 7392); three bills to extend some marriage benefits to same-sex couples have been introduced in the state Assembly (AB 2998, AB 3129, AB 8844).
  • Court action: Lambda filed a case March 5, 2004 on behalf of a same-sex couple seeking the right to marry. The American Civil Liberties Union filed a case July 1, 2004 on behalf of 13 same-sex couples seeking the right to marry. Neither case has gone to trial yet.

    NORTH CAROLINA
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendments banning same-sex marriage were introduced but no action was taken before the legislature adjourned July 18 (H1606, S1057).

  • NORTH DAKOTA
  • Current law: DOMA written into state constitution and state law
  • Legislation: State constitutional amendment banning same-sex marriage placed on the Nov. 2 ballot by citizen initiative groups and approved by voters.

  • OHIO
  • Current law: DOMA written into state constitution and state law

  • OKLAHOMA

Legislation strengthening the state's existing DOMA law was approved. Resolution introduced urging Congress to pass a federal constitutional amendment banning same-sex marriage (HR 1028).

  • OREGON
  • Current Law: DOMA written into state constitution (Multnomah County officials in Portland issued marriage licenses to 3,000 same-sex couples before being ordered to stop by a circuit court judge April 20. The case is likely to go to the state Supreme Court).
  • Legislation: State constitutional amendment banning same-sex marriage placed on the Nov. 2 ballot by citizen initiative groups and approved by 55 percent of voters.
  • Court action: The American Civil Liberties Union has filed a lawsuit seeking recognition of nearly 3,000 marriage licenses granted to same-sex couples by Multnomah County officials. A trial court judge ruled in April 2004 that the marriages were valid and banning same-sex marriage violates the state's constitution. The state Court of Appeals upheld that ruling in July but has stayed the decision until the state Supreme Court considers the matter. A hearing is scheduled before the high court on Nov. 17.

    PENNSYLVANIA
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment is expected to be introduced.

  • RHODE ISLAND
  • Current law: No public policy
  • Legislation: Two bills to adopt state DOMA laws were introduced but failed (HB 7395, HB 7571). Bill that would recognize same-sex marriage has been proposed

  • SOUTH CAROLINA
  • Current law: DOMA adopted as state law
  • Legislation: Bill that would strengthen the state's existing DOMA by forbidding the state to recognize same-sex marriages or to grant marriage-like benefits to same-sex couples pased the House but failed in the Senate (HB 4657). Resolution urging Congress to pass a federal constitutional amendment banning same-sex marriage died in a House committee (H 4736).

  • SOUTH DAKOTA
  • Current law: DOMA adopted as state law
  • Legislation: Bill that would strengthen the state's existing DOMA by forbidding the state to recognize same-sex marriage or to grant marriage-like benefits to same-sex couples was introduced but failed (HB 1289).

  • TENNESSEE
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment banning same-sex marriages gained preliminary approval by both houses of the legislature (HJR 990). The measure must be approved in identical form during the next legislative session in 2005 before going to a statewide vote in 2006.Senate passed a bill March 31 that would strengthen the state's existing DOMA by forbidding the state from recognizing a "civil union or domestic partnership between individuals of the same sex" (SB 2661). Was voted down by a House committee but may be reintroduced. Resolution urging Congress to pass a federal constitutional amendment banning same-sex marriage passed by the Senate and a House committee (SJR 27).

  • TEXAS
  • Current law: DOMA adopted as state law
  • Legislation: Resolution introduced urging Congress to pass a federal constitutional amendment banning same-sex marriage.

  • UTAH
  • Current law: DOMA written into state constitution and state law
  • Legislation: A state constitutional amendment defining marriage as the union between a man and a woman and barring state recognition of any "domestic partnership" was approved by the Legislature and by voters Nov. 2. A bill changing state law to do essentially the same thing was passed by the Legislature and signed by the governor (SB 24).

  • VERMONT
  • Current law: State law defines marriage as union between man and woman, but civil unions created in 2000 to provide same-sex couples access to state-level marriage benefits.
  • Legislation: State constitutional amendment banning same-sex marriage introduced but failed (PR0005). Bill that would allow same-sex couples to marry was introduced but failed (HB 676). Resolution urging Congress to pass a federal constitutional amendment banning same-sex marriage was introduced but failed.

  • VIRGINIA
  • Current law: DOMA adopted as state law
  • Legislation: Both chambers of the Legislature have approved a bill reaffirming that Virginia has no constitutional or legal obligation to recognize marriages, civil unions or domestic partnership contracts between same-sex couples (HB 751). Gov. Mark Warner (D) has not indicated whether he will sign the bill, but it passed by a veto-proof majority. Resolutions urging Congress to pass a federal constitutional amendment banning same-sex marriage passed both houses of the Legislature (HJR 187, SJR 91).

  • WASHINGTON
  • Current law: DOMA adopted as state law
  • Legislation: State constitutional amendment and state law banning same-sex marriage were introduced but died in committee when the legislature adjourned (HJR 4220).
  • Court action: A second Superior Court judge ruled Sep. 7 that banning same-sex couples from marrying violates the state's constitution. If the case, argued by the American Civil Liberties Union on behalf of 11 same-sex couples, is taken up by the state Supreme Court, it likely will be joined with a similar lawsuit filed by Lambda Legal that resulted in the state's first Superior Court ruling to strike down the state's ban against same-sex marriage on Aug. 2. Both judges delayed implementing their ruling to let the high court take up the case.

    WEST VIRGINIA
  • Current law: DOMA adopted as state law
  • Legislation: Resolution introduced urging Congress to pass a federal constitutional amendment banning same-sex marriage

  • WISCONSIN
  • Current law:No DOMA, but state supreme court ruling and Attorney's General opinion held that only heterosexual marriages are legal.
  • Legislation: State constitutional amendment banning same-sex marriage and civil unions has been approved by the both chambers of the Legislature. The legislation must clear both houses again in the 2005 session before going before voters in a statewide referendum. Proposed statute to establish a state DOMA was approved by the Legislature but vetoed by Democratic Gov. Jim Doyle in 2003. (SJR, 63, AJR 66).

  • WYOMING
  • Current law: State law bans same-sex marriage and pre-dates DOMA laws.
  • Legislation: Legislation to enact a state law modeled after DOMA was introduced but failed.

It has become common practice for a clause to be put in a divorce decree about who can stay over at the home of a divorced individual. The clause says something to the effect that "neither party will have a party to whom they are not married in their house overnight.". Well isn't that a nice tidy and "legal" way of making sure that that the bisexual or gay individual remain alone or have to maintain two households for the rest of his/her life. I will never be "allowed" to marry like a free citizen, but he could. What a cruel joke!! You have got to be kidding me!! Government supported discrimination against anyone has got to stop! People don't realize how deep the marriage ban cuts into peoples' basic rights to happiness. The law should be fairly represent and protect the rights of all its citizens. This is wrong Missouri...so wrong!

It's a shame we care about more how we spell words, than how we communicate. Young people are probably smarter when it comes to grammer or spelling or what not,but now they have all of that texting that spells words halfway or just initals, it doesn't matter as long as we know what each other are saying, spelling words as long as you know it means the same thing, shouldn't change the world we just go through sentences faster. Anyway my main point is not even there, my main point is, Just like way, way, back in the days in Egypt or anywhere else the bible mentions, No matter what went down, NO MATTER IN WHAT NAME GOD was addressed, no matter how different we prayed our prayers, There was always proof that it is just one GOD, and that's the one, The One! "Am that I AM" the one that gave us the breath of life the creator. There's not many Gods, I feel sorry for anyone who trusts in any other so called God to rule this forever, What other GOd do you know that has been greater than the Most High? What will you finally say to him when he appears to you in person? ooops? You live the way you want to but that's why the word curse do exist, God forgive them for they no not know what they do or say" Their hearts and minds are lost. Just say as a spoiled stuborn kid would say to his parent, "I know I'm supposed to obey but I don't want to." Just because you decide to ignore GOD does not mean he does not exist. Just remember the same GoD created us all, because we are his creation,I don't care how much DNA we steal and plant it where ever it's the same DNA created from the Most High our ONE GOD. I know it hurts to know it's that simple, but like somebody said that's been known forever. Nothings new under the Sun, including your DNA. Proove to me another GOD besides the one,that I can trust and depend and believe in and I'll shut the H*ll up. Don't get it twisted my GoD is so great, he created us so perfectly, and we are so free, we think we're GOD, but guess who has to face who in the end? and O'yes there is an end... My GOD won every battle so far, since there's such things of lot's of Gods,What other GOD do you Know has ever won anything against him?! and Who or WHaT, hasn't GOD concorded that he wanted to? No one escapes My GOD no matter how Your illusions are of other Gods. Who says GOD hate you? He just hates the works of your hearts, people forever could pray to a shoe, or their golden statues or whatnot, but they never got a thing out of it, must you have to go through what they did? You don't have to tell me twice, because I know I didn't just drop out of the sky. A long, long, time ago a Man named Moses thought the same way, until he spoke to GOD face to face. How do I know it happened? Because Pharoh let his people go. Whoever you decide to be in life besides what GOD want you to be, it's your problem it only becomes mine when what you do cause your life to clash with mine. That's why he made rules, it's on you to believe, they were made to be broken, but you have to face the concequences for causing GOD's blessings to not come through, Maybe this is a blessing for you, to warn you that you do have to face GOD dead or alive one day.

We question everything but nature. How about, "How did we get here and why?" Humans don't just drop out of the sky. There is a creator of Humans, and like other species they have rules of nature.One of our rules is to take care of the world, not mess it up. We were put here by God in a certain order, for that reason, It's like your parent putting you incharge while they are gone. Sometimes things go wrong, maybe because people didn't listen in the past. Of course sometimes we have what we call "freaks" or mistakes of nature, but that's just what They are. Our creator, created us the way we are, that's the way we were meant to live. Today we do have guys named Eve and woman named steve, but the only way to create a real child of God's nature, If your name is steve You'd better be male. If your name is Eve you'd better be female. We can have sex with anything, and it can be against God's plans. If there was another way he wanted us to mate, it would have been as natural for a man to get pregnant, as it is a woman. A woman would give a baby when she gave sperm. God is not the Author of Confusion! We were made in our creator's image to create things that seems impossible, but if we keep going against God's nature pretty soon it won't be nothing real and everything will be all mixed up. Because it's possible to live the way we WANT to live, don't mean we suppost to, I would'nt want my grandchild to one day date a half dog half person one day, so it is my business. It's possible to do anything, but is it the right thing to do? If you climbed a very high mountain, and looked down without any protection, but it looked as though you could fly, Would you jump off of it? If you lived when you jumped, would you tell people it was o.k. to jump because you lived? The foolish things we decide in life to do, we may as well, because some people are crazy enough to jump, Because it feels good, and "everybody" is doing it! And since God let you get by with it, U guess it's the right thing to do. Soon all of the people that are breaking God's rules will see how they've changed the world. People are taken for granted,and God's rules of nature are ignored, but I got news, This is a small world, if everybody decided to be Gay, how will we get our children? I think it's stupid to turn to a woman to carry a hand planted baby, when we were designed as other species were, to mate as male and female. If we were born with another choice then we would be designed with both parts each, Then we say "why did'nt God do it that way so we could?" Dauh, maybe he only wanted a certain amount of people on earth, the way he want them here! Now since God created "Itelligence" And we were blessed with it, Just like your parents teach you, don't mean that we try everything, because it's there, But other people are creating other ways for us to appear, they will have to face the concequences later, and we all have to witness not just "freaks of nature", which probable happened from people messing in the past,Anyway. We'd have to deal with these "man made" freaks too. Then people will have to ask, "Are you created by God or by man", or "Are you a natural creation or a man made?" If everyone was normal we would'nt have to ask. We're not confused on what's full and empty, Hot or cold , dark or light, maybe red and blue, but we should be able to tell who we are, soon we won't even know our perpose here? Soon we won't be intelligent anymore changing our natural "being" Should an ant be more important to God since we don't hear him?

Wow Mr. Espinoza. First of all, I would like you to please understand that public education is free and offered to all in this country. However, it is very clear that you either didn't go to school or decided that your English/Grammar class was the one you were going to skip. The next time you try to bash the gay culture, at least try to make yourself seem sophistcated by using simple punctuations like periods and capital letters.
I'm going to assume, but I could be wrong, that with a last name like Espinoza that you are of some sort of Hispanic ancestry. Don't you like having all of your rights in this country? Being able to marry, have benefits, things that you expect when you live in America. You don't get those rights taken away because you are Hispanic. You get to keep them. And if you did get them taken away or if they were never offered, wouldn't you fight to get them or to get them back?
The fact that religion is even brought into this is ridiculous. There are millions of religions. They all pray to different gods, have different rituals and believe that different things are divine. Your religion may not agree with homosexuality, but that in no way means that all religions don't agree with it. Even if they don't agree, they may not care. People are people no matter what angle you look at it.
Let's discuss spreading diseases. Everyone spreads diseases. I'm not sure which disease you are talking about when you speak of the gay community. People spread cold and flu viruses all the time. Should we take those people's basic rights away from them? If you're speaking of the AIDS epidemic you should do your research. While the media covers the gay communities spreading of AIDS, did you also forget about all the young men and women that have unprotected sex with several partners...which makes it spread. How about the fact that AIDS started in Africa because of religion and cultural beliefs allowing the same men to have many partners and father many children? Were you around for that news? I'm 23 and I know about it. And if you think that being gay is a disease that you can catch, you're simply a moron. It's not possible.
I would venture to say that you encounter at least 2 gay people every day and you don't even know about it. Have they turned you gay yet? Have you caught the 'disease'? Probably not.
Let's address the comment you made about animals. Would it really bother you? Your next door neighbor could be married to a goat. Does that effect you? Could you just not go on being a citizen of your community and a member of society if your neighbor was married to a goat? Again, it doesn't matter. It's not you.
The main problem is that everyone that is so opposed to gay marriage or civil unions don't realize that it only effects the homosexuals. We're not asking you to marry another man. Deal with it. You walk amongst gay people. You probably have no idea because they don't all flaunt that they're gay. And if they do, good for them for being proud and brave enough to do so.
You're a fool my friend. You live in a bubble. One that has for some reason made you think that they way you think is the right way. Homosexuals have been around for thousands of years. Really. Look it up. They've found evidence of homosexual acts in ancient egypt. The problem is people like you exist and convince the people that aren't sure that gays are evil. I'll let you in on a little secret: Those people that usually complain and fight against gay rights normally have hidden homosexual tendencies themselves. Have you ever heard the saying 'Doth protesteth too much'? Your arguemnt fits that quite well. I'd chill if I were you.

I'm sure you've heard of babies born that are not distinctly male or female, but born with anatomical features of both. This is a fact of nature so, knowing this, why would you assume that humans cannot be born feeling more closely linked to one or the other in spite of their outward anatomy? I am a heterosexual female so I'm not speaking from a personal perspective here, but I fully defend the homosexual’s rights to marriage and any other basic right that the rest of us enjoy. There was a time that this country was so in the dark that we thought slavery was acceptable. Isn't it time for us to come out of the dark on the issue of same-sex marriage as well? As others have asked, what do you lose if a homosexual couple marries? How is this any of your concern? In my opinion, it shouldn't even be a question for the law - it is a basic human right. No one tells you what religeon to practice - how can you think it's ok to tell someone else who to love?

First i would like to say to edward espinoza that your religion is your buisness. Everyone has their own religion and some do not believe in the god you may believe in. A diesease you say? So you think i woke up one day and thought i was going to be gay? i know that did not happen. I always thought i like guys but i still dated girls. Its an attraction that you have that you cant help. I believe that all 50 states should legalize same-sex marriage. Marriage was declared a basic right and to take that away from people who cannot help who they fall in love with is wrong! plus how would someone who is gay marry someone who is of the same sex affect you in any way. they wouldnt Marriage i know is based on procreation but their is some people who are capable of having children and decide not to but they are still allowed to get married? the seperation of church and state is not in the constitution. The phrase came from Thomas Jefferson in a letter he wrote to the Danbury Baptists in 1802. Our constitution is written with specific and clear instructions that every citizen has the right to choose their own religion. When someone uses God as their rationale for being against gay marriage they are forcing their religion and Bible on everyone else in this country. This is very clearly unconstitutional.
Your religion is your choice. You can choose to believe and worship any way you wish without being discriminated against by me or anyone else. Just don't expect me to abide by laws that are based solely upon your version of God. There is no place in government institutions, laws or contracts for your religion or mine. Separation of church and state was written into the constitution for a very good reason!

I myself am bisexual, I'm all for gay marriage because it's about love. We do not choose who we fall in love with it just happens. I don't see how it's right that hetrosexual can marry more then once, wheater it be dievorce or a loss of a partner but gays can't marry at all. In the wedding vows it says til death but then why is the dievorce at its highest. I'd be ashamed to agree with that. There are some people in this world that have been married or are married for the wrong reasons, but the gays can't marry because God does not agree, ok for those how think gays are going to hell, well then just let them why are you stopping love?
Those who want to banned it all together are MONSTERS. If you don't want to support it just don't vote.
I'm not a well educated person, I'm not an adult and this statement is not while organized but what is being done is horrible. To stop two people who actually love each other from the happiness of marriage is wrong.

Everyone keeps going on and on about gay marriage and they seem to forget one important fact. Gay marriage is against the will of God and no arguments can refute that. He said that it is an abomination. Any other arguments are irrelevant. Not only that, but back in the 1970's homosexuality was classified as a deviant psycho-sexual disorder by the medical comunity but they were intimidated into deleting the diagnosis by gay activists, not based on new information but on violent hate tactics by the gay community. If gay marriage passes in this state, they can then teach it to children in the schools. I guess when little boys come home and want to have gay weddings with their little male friends, maybe then people will wake up and realize what is going on here. God was totally against Homosexualtiy and if we embrace it, then we are outside His will. Take a look at Sodom and Gomorrah. The scientists have discovered it and found that exactly what the Bible said happened to it, happened to it. If you look at a satellite picture of the area, you will see two white dots over it because of the huge amount of ash covering it. Also, the remaining structures are embedded with 98% pure sulphur in round balls, something that is not found anywhere in nature unless there is geo-thermal activity and there is none there. The other structures show signs of intense heat and melting. The gay community keeps telling the lie that Sodom and Gomorrah was destroyed because of a lack of hospitality but that is not what the Old Testament says. It says that ALL the men in the town wanted to have homosexual sex with the two angels God sent. And God sent his angles to investigate Sodom and Gomorrah because the people cried out against what was going on there so I beg the people of God to cry out against this abomination or we will be creating a law designed to send generations to hell through wrong actions and wrong thinking.

i don't see the problem with same-sex marriage. it's their life. and their life has NOTHiNG to do with anyone else. if it's a sin, it's their sin, not yours. you can believe in it if you want or not, but just because you don't, doesn't mean they have to believe what you do. they have their own minds, they can think for themselves. i'm sick and tired of people judging them for what gender they like. the gender they like has ABSOLUTELY NOTHiNG to do with who they really are. so, all you people who have a problem with it, can keep it to yourselves. your belief's and opinions are not gonna change anyone else's. you're not that special. so keep it inside, and stop trying to change people's thoughts. it's called freedom. and to the gov't and all you other people, you shouldn't care who gets married to who. as long as it's a person, who cares? love is love; whether it's a boy and boy, boy and girl, or girl and girl. if someone falls in love with someone who, "heaven for bid" is the same sex, you should be happy for them. at least they found love. and again, it's no one else's business other than theirs. keep your opinions to yourself. no one cares what you think.

I just want to note that it is obvious which people are against legalizing same-sex marriages, just by the sheer ignorance of their words. I honestly cannot believe that so many people are really so narrow-minded and just plain stupid. How can people say that they "deserve" the rights guaranteed by the constitution, but others do not?! This all just makes me sick. I can't even believe there is still an issue regarding discrimination left? Why haven't we provided equal rights to all by now? Honestly. It is up to us people, the intellectuals, to become more involved and ultimately take control of our own destiny. If you want something done right, you've got to do it yourself. So, apparently it is time to get rid of all of the "holier-than-thou" religious extremists in Congress and get some open-minded, free thinkers into office. Don't even waste your time trying to make them understand, it'd be like trying to teach calculus to a pig. Just stay strong and continue on, but most importantly, never stoop to their level. Keep your heads high and your hearts happy. Justice WILL prevail.
-FYI, all of you morons out there, I am a very happily married heterosexual female, but I know some pretty awesome homosexual people. It all comes down to the content of one's character, and that's it. ;O)

If you're gay, thats your choice but my problem is, why can't homosexuals just do their own thing and stop dragging heterosexual morals into it? When it comes to marriage, just leave us alone, marriage is RELIGIOUS and has been defined (for many centuries now)as a "man & woman", so just let it be. Why can't homosexuals create their own believes w/ a gay personnel that focuses on their same sex life and just let heterosexuals and their marriage morals alone? We're not the same and obviously, we dont have the same believes, so why try and force us to? Why are homo's stirring things up? Just go about your business and live your life without dragging heterosexuals into. So regardless, God and if you dont believe in God, NATURE tells you that a man and woman is to be united to produce offsprings and population, without a man & woman, mankind would die out if Homo's were left unless a gay man has sex w/ a lesbian.Makes sense right? How come we werent then produced w/ both genitals to accommodate what we want? YOU CAN CHOSE TO BE GAY, JUST LEAVE STRAIGHT PEOPLE ALONE. I honestly dont see what all the fuss is about, i went to what was once an all white school in indiana. We changed only five or ten years ago, now look at us were a five star school that is now integrated, and is actually inviting people to come stay with us from diff. countries. We have at least ten or twenty teaches that are gay, our gay population is rising. We have a little over two thousand students enrolled and thirty five percent of them is gay/les./bi. I myself is gay, ive been with my girlfriend for six years, it takes a lot to maintain a stable relationship. We are all human all im saying is the gay population is rising ,and should be reconized as humans. To be allowed marriage , and benefits like everyone else. To be able to have a family like anyone else here without being looked down upon.

I am a human inhabiting the planet Earth. I was born in a small town and then raised as a military brat. I was raised in a Catholic family. I was a Girl Scout for twelve years and a Ballet student for two years. I went to four high schools in my junior year before graduating with a 3.9 from Frank W. Cox High School. I am the daughter of a divorced family due to alcohol and cheating, and I am the sister of two beautiful and strong women. One day, I will save the world and create peace for all places with occurring genocide and murder. In six more years, I will have a masters in Psychology and Linguistics with a minor in education. One day, I will be married, start a family, and have two children. There is no classification for gays. I am a twenty-year-old white, Austrian-Irish, agnostic, homosexual woman, but I am still human. Am I wrong for loving the woman that I have been with unconditionally? I have one of the biggest hearts in the world which is why still I am not angry at the ignorance of so many humans. I am just that...I am human and my blood is the same as anyone else's.

The founders of our country believed our "first liberty" was religious freedom. That can be taken in many ways. First we ought to know what a liberty is. According to Merrian-Webster Online dictionary liberty is...1: the quality or state of being free: a: the power to do as one pleases b: freedom from physical restraint c: freedom from arbitrary or despotic control d: the positive enjoyment of various social, political, or economic rights and privileges e: the power of choice. So if religious freedom is our first liberty than why are gay people persecuted? No I don't see homosexuality as a religion, but if you do not believe homosexuality is against your religion(whatever your religion is and who says you have to have one?)then how is it wrong? By banning gay marriage people are being robbed of their rights. I understand that most(no not all) Christians believe homosexuality is wrong, that is your right, if you don't want to marry someone of the same sex because of your religious beliefs(or just lack of homosexuality...lol) that is your right, however banning gay marriage infringes on others' rights. Our Declaration of Independence states "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.....". Homosexuals are trying to pursue happiness by making a formal commitment to their partners and since they are equal to everyone else, I wonder what the problem is?
I have always been taught that being gay is wrong, however I am gay. I did not choose it, quite the opposite, I fought it with all my strength but that didn't change me. I am who I am, I walk among you and you cannot see a difference. I look like the girl next door and most people rather like me. If I was straight my right to marry would not be questioned.
I can only hope that we continue to fight for our rights and do not let them be taken away because we are made to feel inferior.

It wasn't that long ago that marriage between a black person and a white person was looked down on, if not compleatly illegal. We need to stop looking at people in terms of their race, religion, or sexual orientation. Humans are humans, for all the good and evil that dictates. Gays should have the same rights as any other person in this country. Stop thinking of current social issues by compairing them to a book written two thousand years ago for political reasons and political control.

I have been in a same sex relationship with a man whom I consider my husband for 14 years come this June. We just want the same rights as everyone else. 40 years ago blacks & whites couldn't marry legally. Don't we want to continue to move forward. Arguments people have against it always state the bible. The bible is a reference. If you're going to take everything in it literally then everyone who shaves their heads or curses their parents are supposed to go to hell so there you go-that's about everyone. Also, no one around today was here when the bible was actually written so there's no way of knowing what was actually meant by each passage. God would want us all to love one another & not judge-so let's try that from now on. As for homosexuals being a main cause of spreading AIDS, we are not the main cause of AIDS. Especially lesbians who are the lowest risk group. We just want to have the same legal rights to marry so two people can totally be committed to each other so they can make decisions about the other if something should happen. How would you like it as a heterosexual if you had no say about you spouse in their death or if they had no brain activity? The family could just come in, claim their belongings, and decide their fate? Put yourself if someone else's shoes.

Yeah, it angers me to read the opinions of some of these people. It upsets me that there are actually people out there that would HATE me because of who I love. Honestly though, I'm not worried about it. I will be married to the love of my life and I will be recognized as part of a married couple, by my friends, my family, and one day by the entire U.S. and I don't care what i have to go through to ahcieve this. People have fought stupidity like this since the begining of time and this is no different. Just like freeing the slaves, women's suffrage, and yes, even making interracial marrige legal, this will happen. It's never been a question of whether or not it will happen, it's only a question of when. I can only hope that I live to see the day when two men or two women can be legally recognized as a lawfully married couple. If not, then I hope I can do something to help my children see that day. The girl above me, even if her grammer, spelling, and terms (i.e. lesbos) are severly incorrect. This brings me to the "gays in the Army" discussion. Apparently homophobia in our country is so bad that people can't even suck it up and let homosexuals into the military DURING A WAR. We can fight just as well as anyone else, especially lesbians (haven't you heard the stereotypes?.) Plus, if out gays were allowed to enter the Army there is no doubt in my mind that the number of "troops" would double. Which is more important? Keeping equality from one group of people who want to fight for the lives of the bigots who are torturing them or going into a war without nearly as many soldiers as there would be otherwise. Think about it.

Hey, people out there who say they're Christian, then spout incoherent babble about how homosexuality is against the Bible, you're wrong. Nowhere in the Bible does it say the word homosexual (or, it shouldn't) because there was no word for it at the time the Bible was written. Back in the day, sex was sex, and it didn't matter what gender it was with. The line everyone refers to ("lie with man as with a woman") is actually "lie with mankind as one would with a woman..." which is odd, considering every other noun in the rules before and after (even in that same rule, "woman" is used instead of "womankind") is singular. They would have just said "man", but they didn't. Some Bibles are now edited to say "man", but not the more accurate ones. Go read a few versions of the Bible before spewing hatred everywhere.

I also think you're forgetting the prime rule of Christianity, the Golden Rule, if you will. Tolerance is supposed to be your identifier as a Christian, you must pray in your closet (ie not out in front of people), and you have to accept people no matter what. Note, I'm not calling you stupid- I'm pointing out the flaws in your arguments, and your gross misinterpretations of your religious texts.

Homosexuality is nothing new, it's been around since the dawn of time. If you believe in creation, then it's been around since God created animals (which is first, in one of the creation stories in the Bible, Genesis 1), as there are homosexual animals. It's as natural as heterosexuality, as it's found quite often in nature, and is completely acceptable in most other species. God may not have made Adam and Steve, but he did make the birds and the beasties, which are just as natural as we are- and without sin to boot- and quite a few of them are homosexual.

Final point: Don't judge others in the name of your religion, considering one of the things you're supposed to believe is "Judge not, lest ye be judged." and I doubt most of you are sinless.

I live everyday just like you, I go to school, I go to work, I go home to a family that loves me (excepts me), I walk with one foot infront of the other. I listen to country music, I watch American idol, top chef, the evening news. Then right before i go to bed I call my girlfriend and tell her i love her. Do i sound different? Do i sound like I deserve your discrimination? If i was walking down the street you would never know that i was on my way to her house.

To those men out there who think that it's hot for two girls to be together but gross for two men. Go to hell!

First of all, allowing us marriage wouldn't change the number of gay people in the world. There would be the same number of homosexuals either way...idiot. Being able to get married won't all of a sudden make people want to be queer. And second of all, it's only gay men who can't give blood and it's NOT because of a genetic mutation. I have two issues to address here:
First issue 1. To all of you who fervently maintain that people who are homosexual are that way due to a concious choice: this is a lie. To say this is likened to saying that a black person chooses to be black, or someone with Down Syndrome chooses to have that illness. Unless you are a homosexual, you have no clue how it came about and you should make no attempt to try to explain it. I am gay. I know what it is like and I know why I am gay. I am gay because: I was born that way. I made no choice to do it at all. Around the age of eleven or twelve, when most children begin to have a sexual awakening, I too had this same sexual awakening. But it just so happened that during this period, I happened to find myself attracted physically and emotionally to the same sex, not the opposite. It just came about that way. If you are straight, I can give this to you in a way you can understand. When you were younger and you had your first sexual awakening, did you find yourself faced with the choice between the same or opposite sex? I personally don't believe you did, rather, you just happened to prefer one gender over the other.
While now (I am 15) I am coming to a point where I accept my homosexuality, I did go through many a period when I felt so horribly disgusted and horrified by it that I hated myself. I felt for a long time that it was wrong and I was a filthy person. It was hard to get myself through those struggles but I did. To ANYONE who thinks that I chose to go through those struggles...YOU ARE WRONG!!! NO ONE CHOOSES TO FEEL THAT WAY ABOUT THEMSELVES! It personally insults me.

Second issue 2. To all of you who fervently maintain that to be a homosexual is to sin and be an abomination to God: you let God and I figure that one out. I, contrary to some beliefs and stereotypes, am not a perverted, sex addicted, drug using low life as gays are so often stereotyped to be. I lead a happy and respectable life. I make good grades, I participate in clubs, I have good friends, I am a good person. It is these positive qualities that say I am going to heaven. God made me exactly the way I am, homosexuality included. God has some big plans for me and he certainly wouldn't have made me inherently "sinfull". I have a good relationship with God and through this relationship He has communicated to me that he accepts me for who I am (who He created me to be) and that I am perfect in His eyes and He loves me. This is all the more I need to feel like a more perfect human being. Don't try to judge me for being gay because A. this is a very small and trivial part of who I am and B. the matter is solely between God and I, no one else. So before you try to deride me for happening to be attracted to the same sex, take a good look at all my positive qualities. Who knows, they may just sway you...

Imagine a world where many people believed that marriage should only exist between two people of the same sex. Imagine that laws were passed almost everywhere that banned the marriage between a man and a woman. Imagine if proponents of man-to-woman marriages and heterosexuals were derided for their stance. Imagine you were a heterosexual man or woman and you strongly wished to marry a person of the opposite sex. I noticed a lot of comment referring to the bible in this post. Basically what is being said is that it is ok to have incest within a family but not have gay marriage?! Bottom line is this-if you all would kindly turn to Genesis in YOUR bible, you will see where it clearly states so and so begot so and so-What in the world do you think that means? If Adam and Eve created us all, there had to be incest running rampant! With that said, gay people have just as much right to a union or marriage as the rest of us. Who are you to say they cannot have happiness. This is the same as the discrimination woman had when it comes to voting and black people had when it came to slavery etc. It is a tragedy that 2 people who love eachother cannot be under God in their union. The last time I checked-God does not make mistakes. Every time someone points a finger at someone who is gay-that is what is being said-that GOD made a mistake! How dare you and shame on you! Gay and straight people have the right to love and marry whoever they want-just like interracial marriage. It was felt in the 60's that a black person marrying a white person is wrong but here we are-doing what we like and loving who we want. I'm 17 years old and a few months ago i found out that i have a herniated disc and 2 degenerative discs in my back and i have to get surgery on my back which will lead to more surgeries in the future. the doctors found out that it was genetic and i got it from my mother. the surgery will cost thousands of dollars but luckily we have insurance to pay for it. if we didn't have insurance i probably wouldn't be getting the surgery and i would probably be in pain for the rest of my life. this year(my junior year in hight school) i am doign a term paper for english. i decided to do in on legalizing gay marriage because 4 years ago i found out that my older sister was gay. as i was researching i found out that being gay is genetic. and i asked my mom and she said that she has 2 cousins that are gay, so it most likely came from my moms side. since it is genetic, my sister was born with the gay gene, she didn't choose to be gay and she didn't ask to be gay. denying her the right to marry her partner that she is in love with would be like my insurance company denying me the money i need to pay for my surgery. i didn't choose to have this bad back, i didn't ask for it, and i DEFINATELY did not ask to be in this much pain 24/7. that's why gay marriage should be legal... because they are born gay and they should be able to marry the person they are in love with... whether that person is the same or the opposite sex.

What's the point? Do you all not see that this has happened before? We're just repeating history and as history shows we will get our rights, we always do. Hi, I am 15 year old student. I am a Freshman in High School and in my honors English class I have to write a research project. It's only 950 words or so, but I chose to write it about gay marriage/adoption. I have sort of come to a standstill on the subject of religion. So much so that I have been the subject of even ridicule form my fellow classmates in choosing this subject. In this class I have been the butt of many religious debates. I have stuck by my choice to reseach this topic, however, for the fact that I believe that it is a growing 'problem' that may be a social division that could be substantially problematic to our society. I had many lesbian friends and believe that their rights, not only as people, but as lesbians, should be the same no matter what their orientation. The only problem I am having is trying to make my paper unbiased. I feel that, yes, the bible plays a big part in it, but people are people and you can't help who you love. I, myself, have been struggling with this. I don't know how many statistics are against me. For example, 1 in 9 softball players are lesbians. I play softball, outfield. :) 1 in 4 goalies are lesbians. I play soccer, goalie. :) So I don't understand why it's pressuring me to decide when I know who I am.

I also would like to know why there are so many states making gay marriage illegal when doesn't it say somewhere that the unalienable rights are 'life, liberty, and the pursuit of happiness.' So if loving someone of the same-sex if making you 'happy' then isn't it your right to be with that person? Sorry, to get so off-topic, I just feel that some of these people commenting this article are just trying to put people down in a malicious way. It's not right.

I would like to issue a challenge to all those who think that being gay is a choice. Try for, lets say a month, to not be straight. You dont have to look at people of the same sex sexually, but you cannot look at someone of the opposite sex inaproppriatly even once. And this includes having any sexual thoughts about them or checking them out. I just want to see how long you will last before you inevitably fail. And, if you claim that you did it, i can only imagine it drove you nearly insane. This challenge is under the assumption that you do have a sex life with a member of the opposite sex.

It is my belief that gays are hated because white, male, heterosexuals see gays as breaking the ranks amoungst them. That because of this betrayal that they will loose power in a society that is dominated by white male heterosexuals. Also that white male heterosexuals see the breaking of these "ranks" as showing a loss of power and because of this women will see this and take advantage of their weekness to end misogyny. Because of these thought gay men are often the victims of vicious hate crimes. On Febuary 12th, 2007 Lawrence King, a 15 year old high school student at E.O. Green School in Oxnard, California was shot in the back of the head twice by a fellow student, Brandon McInenery (14 years old), who he had asked to be his Valentine. Lawrence had come out openly as being gay a few weeks prior and had been harassed until the day he was shot and killed. How is it that we as a nation can condone this? When a 15 year old boy is murdered for being openly gay we as a nation are sending out the wrong message. It is use as adults that have taught this behaviour to our children. If it had not been through adult influence, such as parental and influence through media this boy may still be alive. We shape our children as they grow, and because of this it is indirectly us as a nation that pulled the trigger on the gun that killed this boy. I dont want tolerence for gays, that is not enought. Every human being should be seen as a equal to everyone else, this includes gay's, lesbians, men, women, disabled persons, the elderly, and racial minoritys, etc. What i want is acceptance by all with no acception and equal rights for all. And if you wish to argue the point that this is a free nation, I will argue the point that every individual is free, no matter where their are from. You are free to go out and steal something or speak your mind, its the consiquences that may follow that sets us apart. This is a free country, you can choose to be gay, but you may just end up being shot in the back of the head. This is something that we must change at all costs. Our individual freedoms are at stake. We must make this a country where you can openly be who you are without the fear of being murdered.

When was the last time that a gay couple getting married actually affected you? Get over yourselves... I live in a state where gays can get married and I'm proud of that. I live int he state leading a social revolution and I support my state with all my heart and body.

Secondly, it is indeed ok for women to be gay, as so for men. Honestly, I don't know why you're getting your panties in such a twist over gay men, as long as you're not having sex with them you shouldn't worry about it. They're not going to slither out of a dark alley and steal your innocence, I promise. In fact, the probability of you being hit on by a gay man is slim to none I'm sure... First off this article is about a constitutional amendment preventing states from recognizing same sex marriages. It has nothing to do with religion, and it absolutely says nothing about getting into heaven or not if you’re gay. So let’s tackle the issue that concerns this article. The United States is a democracy based on the system of federalism. Federalism is a system in which there is a division of power between state and national governments. The constitution clearly states in the first amendment, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.â€? Marriage is a religious ceremony and participating in this ceremony is exercising your religion, so therefore, “congress shall not prohibit the free exercise of religion.â€? So an amendment preventing states from recognizing same sex marriage: unconstitutional.

Now time to look at my second issue. I am a senior college student studying psychology, currently taking a gender psychology course. I am in the middle of doing research for my class, and no study has definitively proven that sexual orientation is a product of chromosomes. Nothing can be proven when it comes to this situation primarily because there is no chance for a scientific experiment, just as you cannot scientifically prove that smoking causes cancer. Why? Because you cannot take a control group that does not smoke and assign a group to smoke for their entire lives and see what the percentages of lung cancer is. It’s unethical. It is true however that it is widely believed that gender identity, sexual orientation, and sexual preference could possibly be biological. The ring Y chromosome is usually associated with deletions in telomeric regions. It often provokes the loss of the ring chromosome during mitosis. The SRY gene, which is involved in gender determination, is located close to the telomeric region. If the deletions in the telomeric region might include this SRY gene, then gender determination would become corrupt resulting in gender identity disorder, transgender fetishism, and possibly (but not scientifically proven) homosexuality.

My opinion on the subject of gay marriage is not relevant but if anyone was curious I am for it. Who am I to pass judgment on another human being?

Next we should allow the people that pracitce beastiality to marry their companions...right? I am not trying to compare gays and lesbians to animals, but same sex partners is just not how we were made. Men and women were not made to have same sex intercourse therefore they should not be given the right to have a same sex marriage. My belief is based on my religion, yes, but isnt marriage based on religion? Marriage was established so that God could recognize the union between a man and a woman. Gays and lesbians should be given limited rights but why would you want to have your "union" recognized by a God that believes it is a sin in the first place?

Saying that it is against your religion to condone homosexual behavior is not logical. It's against some religions to believe in more than one God, but other religions have their rights in the United States. America is "A Melting Pot" which means we mix many races, and cultures together. We accept EVERYONE. Maybe not individually, but our country does. This has NOTHING to do with religion. It's a personal choice. Who we marry should also have nothing to do with the law. Unless, of course you are under the age of 18, then obviously you wouldn't want your 13 yr old to marry a 40 yr old petifile. Legalizing gay marraige is like giving women the right to vote, and emancipating slaves. It's something that should be given to them, because women voting hasn't hurt this country, and freeing slaves has made this country more tolerable. Giving homosexuals their rights would only make this country better and stronger. Besides, we should be more focused on ending this war.

P.S. I'm also a freshman who is doing their report on rights for homosexuals. I feel strongly on this topic, mostly because I have many family and friends who are homosexual. I respect other opinions on this topic, and I hope everyone respects mine.

I'm an 18 year old straight senior from an Iowa high school. I'm currently writing a paper for my college prep class and ran across this website. After reading some of the comments, I'm a little upset! First of all, I believe that people are gay by birth, not by choice. If it really were a choice, do you really think people would choose to be gay if they knew they were going to have to endure ridicule from their friends, family, society, and lastly, people on this website? I don't think so. Second of all, what are they hurting you? They are human beings trying to live out their life, just as you and I. Maybe they think that being straight is weird; what if the tables turned and they started bashing straights? That would suck. I have been with my partner for eight years. I love her! We live in Utah. A state completely governed by a christian religion. Most of my family believe in this religion. We have stood up for our relationship from day one. My family has come to realize that it's not all about religion. It's about choices. They taught me their religion. I choose not to believe it. They choose to love me and my partner regardless of their beliefs. Most religions practice unconditional love! Marriage should be legalized for same-sex couples, they want to take God out of the constitution, schools and everything else, but when it comes to marriage, all of a sudden they want to bring God back into it? Where is it fair? Marriage is about love, not about what sex u are, everyone should have the same rights, if thats the case, then you should ban people of different races or religions from getting married also! Its getting ridiculous, its not hurting anyone for two people in love to get married, whether same sex or not!

Im a 22 y/o gay male been with my partner for over 2 years we are very happy.... of course we have our ups and downs just like any straight couple.... I hate it when people say "o u just want to be that way"... you think knowing that we may never be allowed to get married... or that we cant have the same rights as a sraight married couple... if somthing were to happen to me, I would want the person I love and have shared so much with to be able to have a say so in medical and legal issues.... just as a married couple would who has shared so much... yea its only been 2 years for us NOW but what about 20 years down the road.... love is love it means as much or little as you want it to...I just wish that people would look at it as more that just being gay... this is human rights.. the right to equality.. we cant change it... can u change your skin color or your sexual preference... all I hope is some day we can have equality..... and maybe get married :) if we want....

My wife and I are nurses in our late fifties and early sixties. We have been together for 11 years. MY wife can no longer work, she has a chronic degenerative illness.

I would like very much to have insurance coverage for her from my employer, but we are not a legal couple, not a domestic partnership, when she dies or when I die we may not be able to inherit, be buried in together, leave "our" estate to "our" children.
How odd. How wrong.
I hope each and every one of you who are so viciously and stupidly opposed to our union comes helpless and sick into my hands, under my care, or some other non person's care, and realize just how very sick you are.

I am just a little angry, and a little afraid, and more than a little desperate and disappointed in this country it's small and silly people.

I believe two people that are in love should have the same rights as any other person that wants to solidify their relationship be it through marriage or a civil union. Too much emphasis is being placed on whats right or wrong. Love is love and commitment means many things to many people. People are too quick to catorgize and cast stones, imagine one you your family members fighting the fight to have their partnership legalized. You would give all you have to fight to protect their thoughts and ideas. I would fight to my last breath to protect my loved ones and help fight for what they believe is right for them. Gays are NOT freaks they are normal functioning human beings with feelings that have morals, beliefs and some have some damn good jobs that provide to the benefit of every community. Lets stop judging and catagorizing people and let us live our lives. If its not bothering you leave it alone. Government needs to lighten up and realize the many contributions millions of gay people are doing for everyone everywhere in every day life. You need to legalize gay marriage and equal rights for everyone.

For those who are Christians or say that same sex marriages are wrong because the "bible says so" I would like to ask you something, How do you know that the bible is 100% true. You beleive in the bible on pure faith. Why do compare it as a law. I could take any book and make it my faith. I am for the rights of same sex marriages. There will be a day where the entire US will recognize them as marriages and not just unions. There was a time when people owned slaves and women were viewed as property. They may have fought for years but in the end did they not achieve their goals. Laws will be made but in time they will crumble and those who choose to have the same sex partners shall rejoice! It is only a matter of waiting and patience before all marriages will be equal.

I just love how everyone loves to always quote Liviticus in the bible. If some people would acually read the bible, and stop making adam and steve jokes, they could see that leviticus is outdated. In the same paragraph which everyone loves to quote abominations verse 22, they will read that it also says it is an abomination to plant more than one type of seed in a farmers field, to eat ANYTHING from the sea, etc... so everyone who eats fish is an abomination as well acording to Liviticus.

My name is Jaime and I have been in a same-sex relationship with Darrell for 6 yrs. Darrell had a son with his ex-wife, who died of Cancer. I have been raising my step-son for 6 years. Who is the one to tell my son that if his father were to die, he would have to move away from the security and family that he now has. Losing all of his parents?? How shameful of anyone to tell me that my son has to suffer because of your insecurities and biotry. Not all gay prefer "Marriage" because quite honestly it is the biggest joke in this country. The "Sanctity of Marriage" today, is violated on by divorce constantly. The average "Marriage" lasts 5 years in this country. "Man shall not lie with man, for it is an abomination to the Lord"? how about "Thou shalt not commit adultery"? I am happy with my partner. We are in this for life. I adore my step-son. His face lights my soul. He is a very well adjusted 12 1/2 year old making all a's and b's in school, with several little girls wanting to "go out with him". So don't tell me I am corrupting him. Neither you nor your "God" can judge me for loving a man. Isn't God Love? I don't want a marriage but if that is the label that you need, so be it! Grow Up! Get a Life, and Live and let live.

In my mind, separation of church and state means keep religion out of politics. If you do that, gay marriage clearly is legal. Plus, scientific studies show that people can't choose to be heterasexual or homosexual. Since our country is at war we should be focused on the bigger issues such at making sure that our wounded soilders are taken care of , that we take care of our veterans, that we make sure that our elderly are taking care and that they get the medication they need and that we ensure the safety of our children instead of making gay marriage a major issue. The U.S is supposed to be a free country but, I guess we are not so free after all if we can not marry the person that we love, weather that person is of the opposite sex or not. If we pay taxes just like a straight person does then we as gays should also have the right to marry and qualify for the same benefits as the straight folks do. The lady that made the comment that the cases of aids virus in the gay community is rising is WRONG. The cases of aids virus is spreading more in the heterosexual community due to so called "straight married men" steppin out on their wives and having sexual encounters with other men. If gays and lesbians can fight in wars and fight for the freedom of our country then we should be able to marry anybody that we love and not have our government tell us who we can marry.

Gay marriage is a lifestyle people may choose to have or may not choose to have, it just comes natural. It is not people's place to judge one another, and to all you people quoting and referencing the bible, i believe something along those lines is in there. Take it to heart. There's only one man who has that power and He is the big man upstairs. This is a "free country", lets start showing it. If that is truely were someones heart is, then let them be. our country has MUCH bigger things to worry about than some man or woman wanting to share their life with another man or woman. Come on people, open your eyes to the real world and get off your pedistals. This country is full of diversity and we as citizens have to be more open-minded and stop living in the past centuries. Our world and our people are changing, what better way to live than to respect other's decisions and accept it.

You can't go completely by the Bible...how do we know what God told man to write? It's supposed to be God-inspired, but the Bible has man interpretations. We don't even know what is right anymore. We only know what MAN has told us. And again..what about the separation of church and state? It is impossible to separate church and state when our laws were based on our religious forefathers...Times have changed..some laws are old. It is time for us to stand together and get them changed. It was also thought, not so many years ago, that it was a sin for interracial marriages to happen. Yet is it widely acccepted now. How is this different? People swore that was in the Bible too..but it was shot down eventually. The US as a society does not like anything out of the normal. But what is normal? I don't mind it not being called a marriage. I don't mind it being called a Civil Union..or just give me a piece of paper let me sign it and give me and my partner the rights as a same-sex couple. It is just going to take more of us to actually do something about this..we have to be louder..and we have to stop hiding!

The United States has this thing that we call "Separation of Church and State." There is more than one religion in this country, that's one reason we call it a MELTING POT. The United States is a so-called "free country," well if so then let homosexual couples marry. Love is Love. If a homosexual couple gets married, how in the world is that hurting anyone else? IT ISN'T. If you don't want to see it then don't look. It's no one else's business anyways about what they do, people should be more concerned with their own lives. I am an Alabamian female who you would consider a 'straight' female. I have been around the glbt community for a long time, and within the last year, have really come to know a lot of the people in the gay community in my home town. One of my best friends is a gay male ... I cannot imagine having a better friend ... I now work at a gay club and spend every weekend within this community. There is such a bond with them that you do not see in the straight community. I admire many of them for the trials and conflicts they have had to overcome in their lives because they were considered 'immoral'. I do not judge race, religion, gender, etc. I believe God created us all the way we are ... I love ALL people... I have friends of different colors and religions and sexual preferances... the hatred of the world cannot end until we stop hating those around us.... Stop stereotyping people and let them live their lives and you live yours...

I am pretty moderate when it comes to most things and the issue of same sex marriage does not seem to strike me as some earth shattering catastrophe. It is not like if homosexuals are allowed to marry, the sun will explode. It will merely mean that two, consenting adults will live together. That seems reasonable to me. They are not asking for your religious beliefs to change, they simply want the 1,138 federal rights, responsibilities, and benefits that our Nation grants to married couples. You can still believe what you want. That is what our Nation is about, offering the freedom of Religion, and not being forced into one that you do not believe in. While the Bible does say homosexuality is a sin, it also states that if a woman marries and is not a virgin, she could legally be stoned! Another interesting fact about America is that not everyone is a Christian. I am one, and even I do not believe that homosexuality is a sin. I believe that God is a forgiving and tolerant God. He would not condemn love. I DO remember Jesus saying "He who is without sin cast the first stone." I do not believe anyone ALIVE can make that claim. If same sex marriage is as truly evil as you believe it is, then let God judge people. I do not believe you have the qualifications.

This is response to Nicole who posted something back in Jan. My partner and I have been in a life partnership marriage for almost six months and we had the support of most of our family. I can respect others opinions and all but I do have to remind you of something Nicole. If God can sit down with the Gypsies and the Whores and have a meal with them and love them and accept them as his children then he can sit down with the homosexual community and accept us and love us for who we are. He made us all very diffrent and that is what makes of all of amazing creatures of his creation. Yes he did make Adam and Eve, and I love that but if you look at the "hertosexual" marriages you will see that there are more families spliting up than in a homosexual marriage (wheather its leagal or not people are still getting married gay or not), and also another while I am on my soap box, what is the issue of gay couples having children. I don't see what the problem is, hell if a crack head woman and her drug dealing husband can a few hundred then I think that gay couples can have a couple of kids too. well there's my peace I look at this way religion and law are suppose to be seperate and thats the way it should stay I am not saying you have to accept it, but that doesn't mean that you can't turn your head. Because people do that everyday when it comes to the war, drugs, rape, murder, and much and this is something that shouldn't become an overwhelming thing, just pass law that gives everyone the same rights we pay taxes we vote, and we can be in the armed forces so why can't we all have the same rights.

For a country who prides itself on being welcoming, open, free, and accepting of all, we seem to discriminate a lot. There is a lot of hate against many groups in this nation.

1. I do not think that gays should be allowed to marry because of the sanctity of the word "marriage". The meaning goes back very far and it is set aside for man and woman.

2. I think that homosexuals should be able to enter civil unions and given the same benefits as a married couple.

It is not our right to judge whether it is right or wrong for someone to be gay. That is GOD's JOB not ours. So everyone on here taht says that gays are bad for it and that they have no right getting married -- that is not YOUR right to say that and to judge them. We are the land of the free. If youa re gay and you want to enter a civil union with your loved one, you have the right to do so as far as I'm concerned. I leave the judging up to God, and I dont' think that gays should be oppressed because they choose to be with someone of the same sex. Whatever happened to everything this country stands for?

I realize that many gays and lesbians say that it's who they are, and that it's part of them. That's how they were made, etc. I'm here to testify that it's a choice! You choose to live that way. You have the choice to live a moral life and do the right thing. I'm not going to slam it either way. I fight for the right to make the choices. However, I know that in the end, our Heavenly Father will judge with righteousness over all his children, and those who chose wrong will not be able to spend eternity with him. I saw a comment on the wall that was inaccurate. The fact is that HIV/AIDs, chlamydia, gonorrhea, syphilis, and several other diseases are more prevalent among men having sex with men. If you do not believe that, check some of the AMA (American Medical Association) and APA (American Psychiatric Association) findings. I do not however condemn gay people. I am a Christian and I refuse to 'cast the first stone.' Just wanted to present the facts.

I applaud the recent ban on gay marriage. Not only are same -sex marriages morally corrupt, they're part of the reason the growth of AIDS and other sexually transmitted diseases are rapidly increasing across the United States. Now why settle for your own gender, if you're having trouble with dating the opposite sex, maybe the opposite sex is not the problem, maybe it's you and the poor choices that you choose for a mate. If you've been abused by the member of the opposite sex, that doesn't mean you should categorize all of them as being bad. Make better choices! Homosexuality is not who a person is, it is a secular trend! A person probably mostly decides to be gay, because they're down on their luck and every one else is doing it. Well all I can say is this, if you choose to be stubborn and live your own life, the people around you may be accepting, but God is watching. He is the one you will have to deal with in the end. In Leviticus 18:22 God states in his word "Do not lie with a man as on does with a woman; that is detestable."
