Lawmakers across the country are doling out tougher punishments for sex offenders – from satellite tracking to the death penalty – but a handful of states are starting to ease up on penalties in cases of youths arrested for sex. Laws enacted this year in Connecticut, Florida, Indiana and Texas try to draw clearer distinctions between sexual predators and adolescents who pose less of a risk, such as those caught in so-called “Romeo and Juliet” relationships. Even when adolescents are only a few years apart, consensual sexual encounters can lead to prosecution.
The case in Georgia of former high school football star Genarlow Wilson, who is serving a mandatory 10-year sentence after receiving consensual oral sex from a 15-year-old girl when he was 17, has attracted national attention, sparked bitter debate in the Legislature and will be decided later this year by the state Supreme Court. Even the author of the statute used against Wilson says the sentence is a miscarriage of justice and wasn’t the intent of the law.
The new state policies take different approaches but share a goal of preventing low-risk adolescents from facing the same penalties as serious predators. Lawmakers who support the laws emphasize that the measures are not “soft” on crime but are designed to eliminate unintended consequences – such as lifetime inclusion on sex-offender registries for young people convicted of less-serious infractions.
“The typical phone call I would get is the mother of a 20-year-old kid who got caught up in this and is now on the sex-offender registry and it’s ruining his life,” said Connecticut state Rep. Mike Lawlor (D), chairman of the House Judiciary Committee and a former prosecutor. Lawlor said states are “getting a little more focused and trying to go after the real predators.”
The new laws come amid an ongoing crackdown on sex offenders. States approved scores of measures targeting sex offenders in 2006, restricting where they can live, authorizing Global Positioning System satellites to track where they go and – in Oklahoma and South Carolina – allowing the death penalty for some sex crimes, according to an analysis by the National Conference of State Legislatures. This year has seen a similar flurry of activity intended to clamp down on sex offenders.
Connecticut lawmakers agreed to a compromise that widens the age gap between consenting sexual partners from two years to three, in an attempt to cut down on the number of “Romeo and Juliet” romances prosecuted. The original legislation called for a four-year gap.
Even with the amended gap, the bill was helped significantly because it was attached to a separate “get-tough” sex offender measure, according to Lawlor and state Sen. John A. Kissel (R), who acknowledged that some Republican lawmakers were “very uncomfortable” about expanding the scope of consensual sex.
Florida’s new policy allows those involved in consensual sexual encounters – with no more than four years between them – to petition to have their names removed from state and national sex offender registries.
In Indiana, a change in the law decriminalizes consensual sex between adolescents if they are found by a court to be in a “dating relationship” with an age difference of four years or less. Under the new policy, courts also will have discretion to determine whether violators should be included in the state’s sex offender registry.
“A teenager could have a lifetime of hell because of a misplaced tag (as a sex offender). But, on the other hand, society could have a hellish situation if we don’t identify the right people,” Indiana state Rep. Ralph Foley (R), who co-authored his state’s bill, told Stateline.org. “We tried to look at both.”
Texas, meanwhile, overhauled a risk-assessment system that, according to critics, allowed some juvenile offenders – including those having consensual sex with a younger partner – to receive a higher risk rating than many serious predators. Based on factors including age and relationship to the victim, the system often over-penalized the young and under-penalized those abusing members of their own family, critics charged. The new system uses revised standards, such as psychological tests, to make assessments.
Mark Chaffin, a researcher with the National Center on the Sexual Behavior of Youth at the University of Oklahoma, said a common complaint about “Romeo and Juliet” cases is that they often are enforced unfairly.
“If they were rigorously enforced across the board, there would massive numbers of adolescents who would adjudicated for these kids of offenses,” Chaffin said. “In many cases, they are enforced largely by how angry the parents of the younger party are.”
To many, the case of Wilson highlights the problems with some sex offender laws. Wilson was convicted of aggravated child molestation and his incarceration has caused heated battles in the Legislature, with some lawmakers scrambling to revise the law to free Wilson and others arguing the court-ordered sentence should stand.
One person who may influence the state Supreme Court, which has taken up the case, is Matt Towery, a former state representative who authored the law used to prosecute Wilson and who argues it was grossly misinterpreted.
“The concept that someone could have been stupid enough – much less abusive enough – to apply a 10-year sentence is just incomprehensible,” Towery said.

My son was 19 yrs old when he met this young lady through his brother and his brothers girlfriend. The young lady told him she was 18 and looked every day of 18-20 years old or older. They met several times and had sexual intercourse. When her mother caught them together, she asked my son if he knew how old she was and he said yes, 18. Her mother then told him that her daugter was 14 and that she was pressing charges. She had everything she needed as proof, my son left a condom in the garbage at the girls house and the mother pulled it out of the garbage and handed it over to the police. The mother and I talked and she told me she was going through a messy divorce becuz her husband slept with a 17 yr old girl, so she wasn't really angry with my son but her husband. She agreed to not press or drop the charges if I'd help her find out info about her husband, which I agreed to and when I gave her the info, she droped the charges. However, 6 months later she called my house at 1:00 am and told me her daughter was pregnant & it was my son's baby. The girl was just over 6 months pregnant and I knew it could be my son's. The mother was nice and said that if he'd help out when the baby got here or allowed her to put it up for adoption she would still not press the charges and he agreed to everything (My son hadn't had contact with this girl since he found out how old she was) When the mother started demanding money and other things and the baby wasn't even here and we didn't know if it was actually my son's yet, we refused and she went to the state attorney's and tried to press charges again, they investigated and sent my son a letter saying that they weren't pressing charges as long as he didn't see the girl again. The next year their was a change in the State Attorney's office, new lawyers came in or were voted in and she kept going back up there until she finally drove someone nuts and they files charges against my son. They were later reduced to causing a minor to become deliquent or dependant, a misdem. The child turned out to be his and the girl kept the baby but they don't allow us to see her at all, my son is saving up his money to file for visitation. I keep wondering how this woman could possibly want her grandchilds father put away, how would that make that little girl feel when she's older and knows she is apart of my son...... My son paid the price for her daughters lies! But I Thank God every day because it could have been alot worse!

i am reading all of this and obviously the government is crooked. i was molested in from the first grade to the third grade... by a coach who was forty two years old he also molested at least thirteen more girls that the law knew of. and he got a whole two years in prison for it... in texas. they need to get the real guys in prison. not the ones who actually want a future with the person. giving 60 years in prison to someone who was only a few years apart is WRONG. its not a joke. if they werent raped or molested... dont charge them for it.

THE CRUX OF THE PROBLEM ARE THE LAW MAKERS WHO PASS LAWS WITHOUT EXPERT ADVISE

It is my educated opinion and that of the experts that sex offender laws as they are written today,âDo More Harm than Good.â? These laws actually endanger children and society.
Megans Law and the Residence restrictions do not protect the children as these regulations intended. They actually make matters worse by creating itinerant predators.
Let me explain,
Incest and friends of the family make up approximately 98% of all sex offenses. There has been estimated that 60 million individuals in this country that has experienced child sexual abuse. 50%, 30 million will go on to abuse a child. This is the crux of the problem, and we are NOT addressing it.
Instead, law makers are creating laws that Do More harm than good. For example,
The public registries. 98% of those come from the family and friends of the family. It is a fact that once caught that 95% of them NEVER EVER repeat another sex crime. And that without therapy.
The remaining 5% are HIDING in the registries. Those who DID NOT know their victims, the violent rapists and the repeat offender.
AND, approximately, 95% of all new sex offenses are committed by individuals NOT on the registries. Is it no wonder because law makers have totally ignored the fact that Incest and friends of the family are the crux of the problem. There are 30 million abusers out there and lawmakers have done NOTHING to address PREVENTION through EDUCATION.
By ignoring incest and friends of the family, law makers have created a GREATER RISK to children and society. If we do not openly discuss it, do not propose any educational models to better inform ourselves and keep ourselves afflicted with guilt and shame which washes over all concerned, perpetrators, victims, and other family members alike, we all help shield and perpetuate the crime.

There is a federal law which gives the politicians a chance to make consensual teen sex a non registrable offense with a four year age difference if the "victim" is at least 13

Romeo and Juliet Law

I just wanted to say that yes, the romeo and juliet law is in the state of texas..Today to my surprise after having to put up my home for 25,000 dollars my son got off on being registered as a sex offender in the state of Texas. He did a sexual act with a fourteen year old while he was seventeen and the same girl's mother had pressed charges against another boy besides my son.However the parents of the girl dropped the cases and the state picked them both up. My son was lucky and I say lucky because I know that the other guy was not so lucky. He however was not so lucky at being just a little over the age limit for the the Romeo and Juliet law.Today is July 21st and I will never forget this day. My son was facing 20 years in the state pen. With hiring a really great lawyer who searched two hours for this just today as he sat in a court house waiting for a district attorney to get to his case. He found this Juliet and Romeo Law. I was never so thankful and I feel for those parents and thier sons and or teens that go through this.Consentual sex is a something that teen age girls need to be taught also not just the boys. My son will still be on ten years probation, a three thousand dollar fine and 750 day of community service and I am thankful. Sounds strange that I could be so thankful for this. He was never so relieved and happy about just facing probation.Truely a travisty is going on here. I again want to let you all know to hire an attorney and make sure they are criminal attorneys, reach out anywhere, do what you got to do.This registering sexual offenders is killing our boys. I would like to also say that it is the parents of these young girls who needs to do the right thing and teach thier teens that half of all the responsibility is thiers. My son is a good boy, just made one mistake and even stopped in the middle of everything, left the girls house, with the mother there after she had gave them permission to watch a movie upstairs with doors shut as she sat in her living room and watched the t.v. Not only one boy.. but two boys and her fourteen year old daughter. Please please I beg you to go to lawyers and beg them if you have to, to take your house as payments . They can do this and can keep titles and deed on your house till you get them repayed. Signed Appreciates her sons amazing lawyer.

When my son was 17 yrs old he was dating a girl that was 14 yrs old, they were 3 years and 5 months apart in age. She decided to run away from home, several times, and would always seek out my son. When the police caught up with her, they would charge my son for harbouring a run-a-way. When this girl would go back home, my son was welcomed there by her mother every time. Once again, she ran away and was found with my son at my home, again they charged my son, (I was at work.) But that wasn't enough, they wanted more, I guess they were blaming my son for her running away instead of her homelife. When her mother came storming into the police station to pick up her daughter. The police ask if my son and his girlfriend where having sex. The mother, being so upset with her daughter blurted out YES. Well, my son had just turned 18 yrs old, so the state proceeded to press charges for aggravated sexual assault. The girl was very upset about this, so the mother never signed any papers to charge my son. She told me herself that she didn't want to press charges. The police are the ones that pressed the issue and got an inditement against my son. He got a 15 year sentence. He is not perfect by any means, I'll be the first to admit that, but he is NOT a sexual predator and now his life is ruined forever. He got out on parole and started dating a former girlfriend, they now have a son. Through my son's own stupidity, I told you he is not perfect, he violated his parole and is now back in prison. His violation was being at the wrong place with so called 'old friends', friends used loosely. He can't hold his own son when we visit, and I am very concerned about what type of relationship they will be 'allowed' to have when my son comes home. I am very interested in the Romeo and Juliet law and if that applies to Texas.

this is regarding my son that is in prison for teen with teen. judge gave him 30 yrs for MTR.
he was 18 yrs old and she was 15 years.
requesting help - my son has already served 4 years when others, are men with children get 3 to 4 years.
the same judge gave another person 60 years for teen with teen.

I also have a grandson who is now 19, but just after he turned 18, he is being charged with rape. The girl said that is was consensual sex. But the state is now going after blood. There is also another girl who is saying that he did things to her for years and is now just saying something about it. It was just things that kids do when they are young. There was no sex involved but just stupid things and because of the other saying they had sex, the DA is really going after him. He is facing maybe 20+ years in prison if the judge decides that. Plus being labeled a sex offender. The letter I read from that one woman is right. These young boys do need help. The one girl who said it has been going on for years, comes and see's him where he works. How afraid is she of him. It always comes down to the boy, your right, it does take two, how about the girl having to pay. Or the parents of these girls. Some of this happened with the parents there. But my grandson instead of running out and doing something stupid, he is working and staying out of trouble. Isn't there something that we can do, or is there someone out there who can help us? We live in Washington State and they are really out for blood with these kids. It's always the boys who are at fault.

THE GIRL WAITED UNTILL SHE WAS 6 MONTHS PREGNANT TO TELL HER MOM ABOUT THE BABY.
THAT WAS IN JANURARY 2005
SHE WAS AT MY HOUSE IN EARLY DEC. 2004
SHE SAID THAT THE RAPE HAPPENED IN AUGUST 2004
THE BABY WAS BORN IN APRIL 2005
MY SON PLEAD OUT TO LEWID AND LESEVIOS ACT ON A MINOR
HE GOT 2 YEARS IN PISION AND 3 YEARS PROBATION AND ALL THE
REQUIREMENTS OF THE REGERISTRY.
WE WENT TO COURT ON NOV.52007 UNDER THE ROMEO AND JULIET LAW AND LOST
SAYING THAT THE SEX WAS NOT CONCENSUAL
THERE WAS NO PROOF OF ANYTHING BUT THAT, THAT IT WAS CONCENSUAL
THERE WERE 2 OTHER TEENS IN THE SAME ROOM DOING THE SAME THING.
MY HUSBAND AND MYSELF WERE THERE AT THE TIME ALONG WITH
2 OF OUR FRIENDS AND WE HEARD NO SCREAMS AND OR FIGHTING AS SHE STATED IN HER DEPOSTION.
IN FACT SHE CONTINUED TO COME TO OUR HOUSE AND SPEND TIME WITH MY SON AND THE FAMILY AFTER THE SO CALLED INCIDENT.
IT WAS ONLY WHEN SHE FOUND OUT THAT SHE WAS PREGNANT THAT SHE CRIED RAPE., ALL BECAUSE SHE KNEW THAT IT WOULD DESTROY HER MOMS REPUTATION AT THIER CHURCH., AND EMBARRASS THEIR FAMILY'S REPUTATION ,SO THEY PUT ALL THE BLAME ON MY SON.
RIGHT AFTER THE COURT DENIED HIS RELEASE OF THE SEX OFFENDER REGERISTERY,MY SON GAVE UP.TO TAKE AWAY THE PAIN AND HUMILATION THAT HE HAD TO DEAL WITH EVERY DAY SINCE THE INCIDENT.HE TRIED TO FIGHT IT ,HE WAS WORKING AND TRYING TO MAKE HIS LIFE BETTER TRYING TO BE WITH HIS FAMILY ,BUT HE LOST THE BATTLE.HE TURNED TO DRUGS HE WAS CONTEMPELETING SUICIDE.AS A LAST DITCH EFFORT TO HELP MY SON I REPORTED HIM TO HIS P.O. OFFICER AND THEY ARRESTED HIM AND HE NOW SITS IN JAIL WHER HE COULD CARE LESS IF HE WERE TO LIVE OR DIE .
HE IS NOT A SEX OFFENDER , NOR IS SHE THEY WERE 2 STUPID KIDS MAKING THE DECESION TO HAVE SEX .THEY BOTH SHOULD SHARE THE BLAME FOR THEIR ACTIONS.NOT JUST MY SON.
THE ACTOINS OF HER PARENTS HAVE DESTROYED MY SONS LIFE AND
THE LIVES OF HIS FAMILY.
HE CAN'T BE WITH HIS DAUGHTER UNSUPERVISED OR HIS NEICE OR HIS STEP BROTHER WHO IS 15.HE IS AFRAID TO GO ANYWHERE OR DO ANYTHIG.
THE LAW IS NOT HELPING THESE YOUNG MEN ,WHO MADE A MISTAKE.INFACT THEY MAKE IT WORSE FOR THEM .ITS LIKE THEIR STILL IN PRISON EVEN THOUGH THEIR NOT.
LOOK AT WHAT IS PROMOTED ON T.V.,IN MAGAZINES.EVERY WHERE WE GO WE SEE YOUNG GIRLS HAVING BABIES , ARE THEY PUTTING ALL THE YOUNG MEN IN PRISON,NO.
WE NEED SOME ONE TO HELP THESE YOUNG MEN.
I HAVE EXHAUSTED ALL THE MONEY I HAVE TO HELP MY SON OUT OF THIS SITUATION TO NO AVAIL.
MY HEART ACHES NOT ONLY FOR MY SON BUT FOR FOR ALL THESE YOUNG MEN
